SMS Terms of Service

This document sets the terms that govern Volo Technology Solutions’ consent-based SMS messaging program, including enrollment, permitted communications, opt-out rights, operational limitations, and legal protections.

1. Agreement to Terms

These SMS Messaging Terms of Service (“Terms”) are a legally binding agreement between you (“User,” “you,” or “your”) and Volo Technology Solutions LLC (“Volo Technology Solutions,” “Volo,” “we,” “us,” or “our”). By opting in to receive SMS messages from Volo Technology Solutions, you agree to these Terms and to the company’s applicable privacy practices.

These Terms apply only to Volo Technology Solutions’ SMS messaging program. They are intended to support lawful, consent-based communications and should be read together with any broader service agreements or privacy notices made available by Volo Technology Solutions.

2. Program Description

Volo Technology Solutions is a managed IT services and cybersecurity provider that uses SMS communications to support customers, clients, and authorized users who have provided prior express consent to receive text messages.

·         Service updates and maintenance notifications

·         Scheduling coordination and appointment reminders

·         Technical support communications and ticket updates

·         Security alerts and account-related notices

·         Billing reminders and administrative follow-up

·         Responses to customer-initiated questions or service requests

Messages sent under this program are transactional, informational, or conversational in nature. They are not intended for unsolicited marketing.

3. Consent to Receive Messages

Volo Technology Solutions does not send unsolicited SMS messages. Enrollment in the messaging program requires clear affirmative consent from the user through an approved opt-in method, such as a website form, onboarding form, service agreement, digital consent workflow, or documented customer request for SMS follow-up.

By opting in, you represent and warrant that you are the authorized user or subscriber of the mobile number provided, that the number is accurate, and that you have authority to grant consent to receive SMS messages at that number.

Your consent is not a condition of purchase and may be revoked at any time by replying STOP.

4. Message Frequency and Content Expectations

Message frequency varies based on your service activity, support interactions, scheduling activity, account events, and related operational needs. Some users may receive several messages during active support engagements, while others may receive occasional notifications only.

All SMS messages will identify Volo Technology Solutions as the sender or will otherwise make the sender identity reasonably clear within the message context.

5. Fees and Carrier Charges

Message and data rates may apply depending on your mobile carrier and service plan. Charges, if any, are billed by and payable to your mobile carrier. Mobile carriers are not liable for delayed or undelivered messages.

6. Opt-Out and Help

You may opt out of the SMS messaging program at any time by replying STOP to any message. After a valid opt-out request is received, Volo Technology Solutions will stop sending further SMS messages to that number unless you later opt in again.

You may request assistance at any time by replying HELP. Additional support is also available through Volo Technology Solutions’ standard service channels.

7. Privacy and Data Use

Volo Technology Solutions uses your mobile number and related messaging data solely for lawful business communications associated with services, support, operations, account administration, and consent management.

Volo Technology Solutions does not sell, rent, or share your personal information with third parties for their marketing purposes. Information may be disclosed to trusted vendors or service providers that support message delivery, recordkeeping, or compliance, or where disclosure is required by law, regulation, legal process, or protection of rights and safety.

8. User Responsibilities

You agree to provide accurate contact information and to promptly notify Volo Technology Solutions if your mobile number changes or is reassigned. You agree not to use the SMS program for unlawful, abusive, fraudulent, or disruptive purposes.

You agree to indemnify, defend, and hold harmless Volo Technology Solutions, its officers, employees, agents, and affiliates from claims, losses, liabilities, damages, costs, and expenses arising out of inaccurate contact information, unauthorized enrollment, misuse of the SMS program, or your violation of these Terms or applicable law.

9. Service Availability and Disclaimer

SMS delivery depends on carrier networks, device compatibility, third-party messaging infrastructure, and other conditions outside of Volo Technology Solutions’ direct control. Service may be delayed, interrupted, or unavailable from time to time.

To the fullest extent permitted by law, the SMS program is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including warranties of availability, timeliness, merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, Volo Technology Solutions shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the SMS program, including delayed delivery, failed delivery, duplicate delivery, unauthorized access, or reliance on message content.

In any event, Volo Technology Solutions’ aggregate liability arising out of or relating to the SMS program shall not exceed the amount, if any, paid by you specifically for SMS-related services during the thirty (30) days preceding the event giving rise to the claim.

11. Compliance

Volo Technology Solutions intends for this SMS program to operate in accordance with applicable laws, regulations, and industry standards, including the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, carrier rules, and A2P 10DLC program requirements.

Nothing in these Terms shall be interpreted to require Volo Technology Solutions to send any message that would be unlawful, noncompliant, or operationally inappropriate.

12. Changes, Suspension, and Termination

Volo Technology Solutions may revise these Terms from time to time. Updated versions may be posted on the company website or provided through other reasonable communication channels. Continued participation in the SMS program after changes become effective constitutes acceptance of the revised Terms.

Volo Technology Solutions may suspend, restrict, or terminate SMS communications at any time for operational, legal, compliance, security, or misuse-related reasons.

13. Governing Law

These Terms are governed by the laws of the State of Louisiana, without regard to conflict of law principles. Any dispute arising from these Terms or the SMS program shall be resolved in a court of competent jurisdiction located in Louisiana, unless applicable law requires otherwise.
